General conditions of sale of Vinogourmets

Article 1: APPLICATION OF GENERAL TERMS OF SALE

Any validation of an order on our website vinogourmets.fr or vinogourmets.com (by clicking on the "confirm my order" button) implies full acceptance by the buyer of these general conditions of sale in their entirety. Any order validated, not regulated within 7 days, will be automatically canceled. The buyer also acknowledges that this contract is governed by French law.

 

Article 2: TERRITORY (Europe)

Only orders made from Metropolitan France and destined for Metropolitan France are accepted, as well as certain European countries that you will find in article 6 delivery costs. No shipping possible to the following countries: United States, Canada, Quebec.

 

Article 3: PRICE

Our prices are indicated except sale or commitment, subject to available stocks. The valid prices are those indicated at the time of the order as they appear on our site (except typographical error or omission). Our site is updated regularly, however stocks are not indicated in real time.

All our prices are displayed including VAT and in EURO (with the exception of “Primeurs” which are exclusive of VAT). The VAT in force is 20% for wines and spirits and 5,5% for groceries. Regarding primeurs, VAT will be paid when the wines are actually available and before their delivery and the VAT rate applied will be The one in force at the time of delivery.

Prices are established by neck, bottle or format indicated, and do not include transport and insurance. For transport and insurance costs, refer to the relevant sections. Orders are without quantitative obligation, unless otherwise indicated. The rates are non-contractual.

 

Article 4: PAYMENT METHOD

Payment can be made by credit card, check or bank transfer according to the terms below:

Payment by credit card :  Payment is secured by an SSL-based online payment system.

Payment by bank transfer :  you can send us a transfer through our partner bank. You will find all our bank details when ordering when choosing your method of payment. Your order will be shipped upon receipt of your transfer. 

We reserve the right to request payment by bank transfer in advance rather than by credit card in the event that we consider it useful for the security of the transaction.

Orders will only be effective and final upon receipt of payment from the buyer. Any order not paid within a week will be canceled without formalities. Upon receipt of payment from the buyer, an invoice will be sent to the address indicated as the billing address. The goods remain the entire property of VINOGOURMETS until full payment, including VAT, of the total price of the order.

 

Article 5: TIME LIMIT AND AVAILABILITY

The delivery preparation phase takes effect after full payment of the invoice, including VAT. The order will be sent at once to the place, to the address indicated by the buyer during the validation of the order. Delivery in mainland France will be made within an indicative period generally of 2 to 8 days depending on the destination, except in cases of force majeure (war, riot, fire, strikes, accidents and the impossibility of being approved, without this list being exhaustive, will be considered as cases of force majeure and will release the seller from his obligation to deliver). Deliveries could only be made to the extent of available stocks. If the order definitely cannot be made, it will be fully refunded or extended in agreement with the buyer. Considering the rare or speculative nature of certain products, restrictions on the quantities available may be applied. Article 6: SHIPPING COSTS

The products ordered can be removed by the care of the buyer at our premises or shipped by us.

Pick-up by the buyer on our premises (store pick-up):  this method of delivery is not subject to any charge if the goods are removed within 60 days of the date of the order. Beyond that, custody and storage costs may be charged to the buyer.

Receipt of goods :

It is essential that the person receiving the order removes the contents of the shipment before signing the carrier's slip. Article 7: FIDELITY

The VINOGOURMETS loyalty account allows you to accumulate points from the first purchase exclusively on our website.
Points are cumulative on all purchases according to the scale of 1 euro spent entitles you to a credit of 1 point (on the price actually paid during online payment). Points can be accumulated on all purchases on the site www.vinogourmets.fr  . When making a purchase on the website, the points of sale are credited as soon as your payment is validated. Only a whole number of points can be credited. Article 8: SPONSORSHIP

This operation is reserved for all customers of the www.vinogourmets.fr site wishing to participate. Any adult natural person, residing in metropolitan France, having made at least one online purchase on the site www.vinogourmets.fr . Article 9: WITHDRAWAL PERIOD

The exchange (depending on availability) or the refund of the order (excluding insurance and delivery costs) will be made within 30 days of receipt of the return of the order.
